Convicted rapist Danny Masterson has agreed to give his estranged wife, Bijou Phillips, custody of their daughter as he serves a 30-year prison sentence.
According to court documents obtained by TMZ, the “That ’70s Show” actor is allowing the “Raising Hope” alum to have both legal and physical custody of their 9-year-old daughter, Fianna.
Masterson has asked for visitation rights, which, if granted, would be given under supervision at the prison.
In September, the 47-year-old actor was sentenced to 30 years to life in prison for two rapes he committed in 2003.
Masterson was found guilty of his crimes in May during a retrial after the first trial resulted in a hung jury in November 2022.
Phillips, 43, had remained by her husband’s side throughout the trial, often walking by his side when they walked in and out of the courtroom together.

It was even reported that the former model still believed the “Face/Off” actor was innocent.
She even wrote a letter to the judge ahead of the sentencing vouching for Masterson’s character, calling him an “amazing father.”
“We need him more than you can imagine,” she wrote in the letter. “I know he has been convicted of serious crimes. But the man I married has only been an extraordinary husband to me and a devoted father to our daughter.”
Still, the “Havoc” actress filed for divorce nearly two weeks after his sentencing.
Her attorney told TMZ, “Ms. Phillips has decided to file for divorce from her husband during this unfortunate time. Her priority remains with her daughter.”
According to California court documents obtained by Page Six, Phillips cited irreconcilable differences as the reason for the split and is seeking spousal support.
She also requested in the docs that any financial support for Masterson — whom she wed in October 2011 — be denied.
Following the filing, the mom of one was seen walking out of a real estate office in Los Olivos, Calif., while still wearing her wedding band.
